eProvided PRIVACY POLICY
eProvided.com respects your privacy. We do not sell, rent or loan information regarding our clients to any third party. Any and all information that is submitted to us is held in complete confidence under United States laws. Images and data is/are never shared for any reason to anyone; specific data recovery or image recovery privacy forms will be signed on request.

IMAGE RECOVERY - DATA RECOVERY POLICY
Non-Disclosure of Customer Data: Your recovered data is most valuable and we treat it as if it were our own. Our labs are private and entered only by eProvided staff. We protect the privacy of your data, any media or equipment unclaimed after 14 days is destroyed. Backed up copies of your data is for verification of the integrity of your data, for your protection, and for eProvided use only. We are always agreeable to signing any custom Non-Disclosure Agreement you might care to deliver to us by means of Fax, Snail mail or e-mail. Repair USB flash drive issues and USB microchip repair & motherboard repairs are an additional cost as stated on the data recovery and photo recovery costs page. If client/customer/person tells us (via phone/e-mail/voice/etc) they are thinking of a decision on either to move forward or not move forward on a data recovery project/order/etc and we do not hear back from them within 24-48 hours than we have the right to recycle the device in our possession. If data recovery services have been requested/started we will not halt the attempt unless you notify us in writing. (on more difficult recoveries it may take a long time for a success) By visiting our site or sending in any eProvided forms you agree that you understand and agree to the details of this page and it's policies, terms and conditions.
ARCHIVED RETURN OF DATA - RESTORATION OF SAVED / ARCHIVED DATA
Any data archived that a client requests an additional copy of later (After 30 Days) will be assessed a charge of $100.00/Hour to retrieve and restore. (This usually applies to clients / customers whom request copies of data that was recovered previously and than lost again for whatever reason not in the control of eProvided.com)
Any data we collect for purposes of contacting you or your employees will not be released to any other company without your explicit permission.
TERMS/CONDITIONS - SERVICES ALREADY STARTED - CANCELATION FEES
All work order or case file authorizations (Signed Forms, Return Material Authorization Number or RMA#) become binding agreements after the required credit card number has been furnished. eProvided.com reserves the right to cancel any data recovery services before any fees have been collected and will return the undamaged media to you with return shipping paid by you. Cancellation by client after work has been performed or has begun or after we have received your media or if we need to collect a debt will incur a cancellation/service fee of $150.00. If you agree to begin advanced or simple recovery analysis or attempts payment will be due or kept if there is or is not a success. We accept all major credit cards via Paypal.Com. eProvided.com accepts Purchase Orders (PO's) on approved terms. eProvided.com does its best to perform within the time frame quoted, however, there are circumstances that are outside our control that could delay recovery. After any work has begun, if as a result of such a delay you decide to cancel any work, you could be held responsible for the cancellation fees unless we are notified in writing to halt the recovery service. If we give you the customer a final warning to contact us and than have to locate your device after the warning has expired/passed there will be a $100.00 archive cost.
NO DATA / NO COST POLICY
If eProvided.com is not able to "recover data" from your disks or other devices for any reason after all attempts at recovery have been exhausted than an explanation will be provided to you and you will be charged only the cost to return and ship your drive or other media. There is no charge for the attempted data recovery other than analysis fees that eProvided.com keeps to a minimum. (basic recovery analysis is $20.00, advanced recovery analysis is $95.00-$150.00, simple fix recoveries vary by quote and are anywhere from $100.00-$450.00 - data delivery and successful data recovery service costs in advanced recovery are $150.00-$750.00 plus parts (8% of recovery fee) We will scrap all customer cards/drives or other media not claimed after 14 days unless recovery of any kind has begun. Any requests for refunds must be sent to eProvided.com - Data Recovery in writing within the first 14 days after you receive your data/materials. This does not include any programs or operating systems, etc.
SECOND ATTEMPT POLICY
eProvided.com prices are some of the lowest in the industry, we would rather not handle second attempts on data recovery services of any kind. (Mainly hard drives and not necessarily media cards/flash memory) If you have had another company attempt any type of recovery of data we would rather not evaluate it. Other reasons: most data recovery companies use much higher quoted pricing scheme and if you refuse to pay the "higher price" that you most likely will be quoted, they will destroy your drive and the data on it. (Eight out of ten client cases we evaluated that were "2nd attempts"). This is an expected but common ploy in the data recovery industries. We may make special exceptions to this rule yet if you send a drive to eProvided.com for evaluation that had previously been sent to a competitor and you never did disclose this information to us than an evaluation fee could apply.
OTHER VARIOUS POLICIES HARD DRIVE RECOVERY, USB DATA RECOVERY, ETC, SALES POLICY
Satisfaction by our clients is important to us. Sales of all new products are warranted by eProvided - Data Recovery for at least 90 days, unless otherwise stated. Most "New" Hard Disk Drives/Media Devices also carry a Factory Warranty that ranges from one year to five years or more. Products with Factory Warranties may be returned to eProvided for processing. Warranties are restricted to limitations stated herein. Warranties are, at the discretion of eProvided.com - Data Recovery & Media Recovery, and limited to the repair or replacement of the defective products. Warranty could become void in cases where products have been modified, opened or have become defective due to other circumstances beyond the control of eProvided.com.
NO REPAIR - NO COST POLICY
For any reason if eProvided.com is unable to effectively repair a disk drive or any other piece of equipment, explanation will be supplied when returned and there will be "NO CHARGE" for the corresponding recovery services. Warranty Repairs where no problem is found and extensive testing shows equipment to be fully functional than eProvided.com may return the equipment as is or exchange it for like product. Contact Technical Support before returning merchandise. There are shipping & analysis fees. Some device that undergo advanced recovery may not be returned, this is at the discretion of eProvided to protect out practices and workmanship and how it relates to trade secrets or industry secrets.
WHAT TO INCLUDE/EXPECT WHEN SHIPPING ITEMS/ISSUES TO US
For any device/issue sent in the cd driver disks and all corresponding connectors, USB cables and plugs/cords should be included. Any shipping/packaging materials, boxes, containers shipped into us will not be returned, we will ship back only devices or products and in our own packaging.
SHIPPING TERMS - SHIPPING DAMAGE
Damage to any product / packaging or contents must be reported to and compensation claimed from the responsible carrier such as FedEx, UPS in a timely manner, usually within one week. eProvided.com cannot file a claim for shipping damages. eProvided.com is not responsible for lost media or media sent improperly. Sending in media devices in plain business envelopes is automatically considered out of the control and responsibility of eProvided.com. Shipping devices such as hard drives or media cards incorrectly is your responsibility in all cases. When we ship anything to our customers we use USPS unless otherwise requested in writing by our clients/customers. If a shipment is lost or damaged or returned to you with something missing it is not the responsibility of eProvided.com. eProvided.com will not track/insure/signature request delivery packages unless by request SPECIFICALLY IN WRITING by the client/customer before shipment is made/sent/managed/handled. These shipping arrangements & tracking requests must be requested before the case is started.
If as requested on the form you signed the shipping/analysis fee is not included in the order, we reserve the right to charge services fees up to $75.00 for collecting this money. We will not return the belongings to people that cant follow simple directions, if monies are due and not included as requested.
Shipment/Tracking Requests (Return Shipping) via FedEx, UPS, DHL, or any other party besides USPS - Add $30.00 - International Add �20.00
There is a $5.00 Fee if not enough postage is paid when sending media & eProvided must make special trips to shipping centers such as USPS, UPS, FedEx, DHL, etc.
Shipping During Holidays - It is the senders responsibility to understand that the dates surrounding major holidays may present a problem where items are not delivered on time or are delayed in being received. It is not a responsibility of eProvided for these types of issues. If mail is placed on hold or delayed we will attempt to receive these packages after the arrival back in our offices.
NON-DEFECTIVE MERCHANDISE RETURNS
If you wish to return purchased equipment, eProvided.com will refund or credit you within 14 days of date of shipment. A 20% restocking fee could apply. All sales are final after 15 days.
SERVICE FEES
We will charge fees that cover shipping if needed when postage is not applied correctly, we will charge fees to cover transaction costs of any kind that are above the normal recovery fees you are quoted. If customers fail to send in payments and time is needed to collect payment not sent as requested we have the right to charge fees for the time spent to collect these requested payments. We will also charge fees to cover taxes that we pay as these are costs to us above the normal recovery fee we receive, thus it is a way to cover expenses to prevent us to bring our recovery fees higher to make up for this same cost to us.
RETURN DEFECTIVE EQUIPMENT INFORMATION / SHIPPING-ANALYSIS FEES
Call our Information Technical department prior to returning any products. Certain problems are ones which our technical staff can help you resolve immediately. It should be returned in the original box with its packing material. Return freight must be prepaid and insured for the invoiced/repair value. COD's will be refused. An additional freight charge will apply for express shipments. Shipping/Analysis charges cover shipping and analysis costs and time. Your return shipment should include:
- Name, address 1 telephone number
- A copy of the invoice or packing slip
- Reason for return
BOUNCED CHECKS - INVALID CREDIT CARDS - STOP PAYMENTS - COURTS
We DO NOT tolerate bounced checks, bad credit cards, etc., or stop payments for services already provided and will prosecute those who fail to issue good checks/credit cards or provide non valid credit card numbers no matter what for services performed. (This is a misdemeanor) A bounced check or non valid credit card or stop payment on a check, etc is subject to a $150.00 bounced check fee and any other costs in seeking payment that is incurred by eProvided. If we sent you a check and you lost it there will be a $40.00 fee if we need to place a stop check payment. Colorado state law applies to this Agreement and any disputes arising there under resulting in litigation shall be litigated in the courts of Colorado. If any litigation arises or is needed where United States law or Colorado state law does not hold precedence than Receiving Party AGREES to litigation under the law or the regional law based on the current or any new address of receiving party or your current legal address.
STATUS REQUESTS & RUSH SERVICE POLICIES
We do not tolerate those who do not read the instructions on materials sent in with orders. We do our best to keep costs low, those who refuse to obey status update policies will be charged rush fees. If you need rush services and cut corners and continue to ask for status updates on non rush orders rush fees will be applied. New eProvided Check Status/Order Page Located HERE. We reserve the right to keep any materials/devices sent into eProvided if any of the policies on this page are not obeyed. Rush orders are handled as first in first out. Rush orders are put in front of any non rush orders. Rush services are handled when we are operating under normal working non holiday hours. If anyone applies a rush on any project the rush fee will be applied and not refunded for rushing the service even if there is a recovery or if there is not a recovery. We reserve the right to add rush fees to any order we feel is being rushed by the sender. If a rush fee is paid by business or personal check we DO reserve the right to hold all materials until payment has cleared our bank. Don't call for status updates unless you have not heard from us for over 1 week from last contact or mailing in a device. Example: 1) customer sends in an order, does not place rush on order, 2) customer calls asking for status updates once or more than once, asks if the device arrived etc. If you want to know if it arrived send using FedEx or UPS etc and ask for tracking through that carrier, we are not responsible for tracking your orders with these carriers, they are. We have the right internally to add rush fees to orders that are being rushed by the client; if we add a rush fee and it is not paid we WILL NOT return the order unless the rush fee has been paid as it HAS BEEN RUSHED. In short for those who need this written for the third time, if you want a rush pay for it in advance or it will be applied, there are plenty of customers that pay rush fees and deserve our highest attention to detail. If you are not one of them than do not ruin it for everyone else. This is our way to keep costs low for You!
TECHNICAL SUPPORT - TECHNICAL SUPPORT FOR DEVICES SHIPPED
Technical staff will be happy to offer assistance on any physical product received in to eProvided.com. Phone support is available during our normal business hours. Once data is delivered eProvided is not responsible for support services on the device that holds the delivered data, eProvided does use standard every day devices to deliver data. If you receive data and you need technical support on the use of the device please contact your own IT department of any local computer support store. We will not be responsible for making the device work, the devices we ship are fully tested and operate normally when shipped out. Recovered files are recovered exactly as they are on the original device, you need to contact your IT department with any issues with the workings of the files, file security, read/write access and all other settings. All devices are plug and play, if your computer is configured correctly, plug it in and move your data. If you must have support a $150.00 per hour fee will be applied.
Delivery of Recovered Data Online
Technical staff will be happy for an additional fee to upload all data recovered securely and send a link to download the data online. We are not responsible for refunding these fees if your internet connection is slow and can't handle the load of the downloadable files due to ISP download speeds. If you attempt download more then 3 times on the same file we can reserve the right to remove the files online and consider the download service completed.
We ask always for you to report to us once you have downloaded the files successfully from our servers, if you do not we reserve the right to remove the files due to security concerns. If we need to upload your files again, you will need to pay the upload fee once again.
Recovered Data Operating Systems - Codecs, Unusual File Types & More
Technical staff will be happy to attempt testing of files. Many recovered files require specialized codecs or software on the customers end that we may not have access to, it is the customers responsibility to include this software or any codecs required for checking if files work correctly by emailing or sending them in with their order. We reserve the right to deliver recovered data to the customer if we feel the files are working and we will consider the data recovered. Many video files can be opened with VLC media player (Download Video Lan). If we can open your videos using VLC than we consider the files working. If you need to open various formats of image files than Google's Picasa is the best out there for such dealings (Download Picasa).
Operating Systems
We recover data on Windows Based Operating Systems (OS), if Zipped (.zip) up or Rar'd (.rar) files are delivered to client they will be windows based, if your on a Macintosh, please expand all files onto an external drive recognized by both Windows based OS and Macintosh based OS. Once uncompressed, than plug drive onto a Macintosh and use your files.
LEGAL
eProvided.com does not guarantee recovery in all situations. I understand that I am in no way guaranteed that any files will be recovered from the supplied media regardless of any expressed or implied comments. I indemnify, defend, and hold harmless eProvided.com for any and all liability, demands, actions, liens, losses, damages, costs, judgments, and expense, including reasonable attorney's fees arising out of or resulting from any eProvided.com services. I agree to pay all judgments, fines, fees, costs, expenses & attorneys' fees incurred in any legal proceedings against me.
Bad Credit Customers
eProvided.Com does make public information about customers that have an long outstanding balance on their account. To avoid this please make past due payments if you agreed to have services performed.
Trade Secrets
eProvided.com will not share for any reason the processes or techniques used for data recovery as these are trade secrets learned over time at our offices/labs. If service has been canceled by client after service has begun we will not disclose what attempts have been made. Data recovery services and all methods used to repair, recover and deliver data will be kept strictly confidential.
